You are officially the buyer only once there is full agreement on three key elements:
- The purchase price
- The transfer date (acceptance)
- Any resolutive conditions (ontbindende voorwaarden)
However, verbal agreement is not enough. Under Dutch law, the written agreement requirement (schriftelijkheidsvereiste) applies. This means a formal purchase agreement must be drawn up, usually by a notary in Amsterdam.
This contract includes all the terms agreed upon verbally and often additional clauses, such as a penalty clause. The deal only becomes binding once:
- Both parties have signed the contract
- The buyer’s three-day legal cooling-off period has passed
It’s important to note that resolutive conditions (e.g. financing, building inspection) must be agreed upon before the contract is signed. These conditions protect the buyer and should be approached with care and tailored to your situation.
