It is a good time to be a homeowner in Amsterdam. Home prices are rising rapidly. For those who also rent out their home temporarily on Airbnb, the additional rental income can be attractive. However, it is important to follow the rules carefully. One Amsterdam landlord has received a record fine for breaking the regulations. What should you pay attention to?
You are allowed to rent out your home through Airbnb in Amsterdam, but the municipality has set clear rules. Be aware that penalties for violations can be significant.
Fine of €297,000
An owner of a building with eleven apartments received a fine for renting out homes through Airbnb for more than 60 days per year. The fine was €13,500 per apartment, which adds up to €148,500 in total. The rentals were handled by the key management company Iamb&b, which received the same fine. According to the municipality, this was considered an illegal hotel operation. The violation was discovered thanks to reports from local residents.
The fine was not only issued because the apartments were rented out for more than 60 days per year. It was also determined that the apartments did not have a primary resident, which is a requirement for Airbnb rentals.
Does renting out your home involve risks?
You do not need to be discouraged by fines from the municipality, as long as you follow the rules properly. You will not encounter problems with the municipality if you stay within the legal boundaries. Issues may arise if your tenants cause a disturbance or if you rent out your property to more than four people at a time, as this is not permitted.
There are also other risks to consider. Make sure your home and contents insurance provider is informed about the rental activity. If you do not notify your insurer, you risk losing coverage in the event of a fire.
What are the requirements for renting out your home through Airbnb?
In summary, the municipality of Amsterdam has set the following requirements and conditions:
- Rental for a maximum of 60 days per year
- The home or apartment must have a primary resident
- The rental must not cause a nuisance
- No more than four tenants at a time
- Tourist tax must be paid
- The home must be designated for residential use
- Permission from the homeowners’ association (VvE) is required
- The home must meet fire safety standards
With proper guidance, renting out your home can be profitable
Stories about fines can be off-putting, but this is often unnecessary. Problems generally only occur if there is ongoing nuisance. What you purchase also matters. An apartment with poor sound insulation is more likely to generate complaints than one that has been designed with soundproofing in mind.
